Player 1 is. Since you can use any 5 cards....
Player 1 would choose to use : 9-9-K-K-ACE KICKER
Player 2 would choose to use : 9-9-K-K-8 KICKER
There's no such hand as three pair, so that 8 would be the best card for player 2 to use, but it's still not as good as player 1's kicker.

Player 1 is the winner because Player 2 didn't bet the flop/turn hard enough.
