I just started playing texas hold 'em online recently, within the last several months. I play at several different sites online. A situation just occurred that took me by surprise as it has never happened to me at other sites.
I took an unfair beat, imo, on a hand. I as well as another player both had flushes to the Ace, which was a community card. In ALL the sites that I play at the pot is split, besides the one I just started playing at a couple of days ago. Because the other player had a higher card in his hand of the flush suit they gave the pot to him.
Since I've called the sites I play at, party poker, bodog, 5 dimes, and a couple of others. Every single site said in the above situation the pot is split. I complained to the site in question and they said his "kicker" was higher. I told them that as far as I know a flush doesn't have a "kicker", that if the highest card is a community card the pot is split.
Can someone steer me to texas hold 'em rules on the 'net that talks about this very situation. I've looked and cannot find anything on this particular issue.

No you were beat. If the A was a community card, and you have QJ and someone else hase K9, the K9 gets the pot.

I don't need to steer you towards rules, I can tell you that In Texas Hold'em, the kicker does apply.
Here is an example.
the board reada A54 of diamonds
You hold K7 diamonds
I Hold Q2diamonds
You win with an AK high flush.

In this case, the site is right. If, for instance, his flush was A K 10 5 3 hearts and yours was A Q J 6 2, because he has the next highest flush card after the community Ace, his hand is higher than yours because the King beats the Queen.

appreciate your feedback, and I guess it makes me feel a little better. But what upsets me know is the sites at where I've been playing, such as party poker, bodog, and 5dimes, at each and every one of those sites the situation I described is a split pot.
I had the guy beat off the flop with 2 pair, A's and 4's, when 3 of the first 4 cards fell club I knew he may have a flush, but I also had a 4 of clubs, so figured if the river was a club we'd both have an A high flush and split the pot.

i think you described it wrong to most sites to make the hand appeal to your favor. had you described it from a non biased POV, you would have gotten correct answers from everyone.

I'd double check that about Party. It's where I play and they don't split in that situation.
two pair can be split however.
you= A 9
him= A 8
board A K K J 5
The J giving you both equal kicker

guys, I explained it exactly how it happened and Party poker as well as 5 dimes told me that is a split pot. I told them we both had A high flush yet he had a higher card of the flush suit in his hand, they as well as bodog told me that is a split pot....just tellin' what they said. Not to mention at 5 dimes this situation has happened to me, where I had the higher card in my hand, but because the highest was a community card the pot was split. Call 'em yourself if you doubt it.

i dont have to call them, ive played party and bodog and it is NOT a split pot in that situation. call them again and ask them in a way thats not confusing and you will get a real answer.

That could be difficult, I believe their Customer service is outsourced to India.

just called bodog, and they said what you guys have stated. 5dimes certainly doesn't although, and unfortunately that's where I've played most of the poker I've played so far. Guess I should've looked into the rules a little more on my own than from my experience with them.
