Two people have a straight each, both making it with one card in the hole and 4 in the community, one person claims to win with an Ace Kicker, the other claims there is no kicker because the best five cards are in the straight, who is right?

100% if they both use the same card to make the str8.
For example-board 7 8 T J and one has T 9 and the other has A 9-split pot.
According to your question, if the board was 10 J Q K, and one has the A and the other person has a 9, then the A wins. But that is only if the players use different cards to make a str8. Any simliar str8 is a split pot, best 5 cards no kicker, no 6th card. EVER.

If you're wanting a second opinion project I'll second Dave's answer. As long as both of their straights were the same then it's a split pot. No kickers used with straights or flushes.

Thanks guys I thought so but I still may have difficulty convincing my friend because there is only one person he trusts for this sort of thing. Have you ever heard of a house rule that in the instance of a tie like this the "kicker" being the other card, if it is higher than the one say I am holding he would win

House rules can say just about anything, that's why I always like to make sure I know all of them before I start playing. Honestly, unless that is the only place you can play, find somewhere else if that's the rule.
It's really simple, in Texas Hold'em, the best 5 card hand wins the pot. No exceptions.

I'd have to agree with jwrussell on this one, if that indeed is a house rule, I wouldn't play there. No way in hell would I give up money to a hand that was decided with a 6th card kicker.

I was playing heads up with a buddy it was just mind blowing to me that he would say he won because he has been playing longer than I have and I didn't want to burry him with remarks on him being an idiot I just suggested that maybe it was a house rule because we were playing in a bar and two other jackholes played somewhere where they do play with a 6th card kicker and they were just a mess.

The kicker does come into play a good bit but it's not necessarily the other card in a players hand. This is a common problem with beginners though. As a matter of fact, that was my first question on this forum a good while back. Say player A hold A 10 and player B holds 10 5 and the board has 3 3 8 J 10. Both players have two pair 10's and 3's but player A wins the pot because his Ace is a higher kicker. Now if the player A hold 2 10 and player B holds 10 5 with the board reading 3 3 8 J 10 then they both have the same two pair 10's and 3's but using all seven cards they split this pot because since the J on the board is the next highest card it is used as the kicker and they both share it. Make sense?

So 3 pairs if your low kicker pairs the board beats 2 pair an Ace kicker?
K K Q 3 2 w/ AQ against Q3
What if you have the same str8, but one player has an Ace and the other has a K w/ the 5th card on the board being a K.
K 9 8 6 5 w/ A7 against K7
If you can play 6 cards, why not seven?
What about 6 cards str8s outkicking 5 cards str8s?
T 9 8 7 2 w/ AJ losing to J6
If you friend can clearly answer these questions without thinking, then he wins-his "house" rule can stand. Otherwise, he is a moron (which we know is the case).

Thanks guys, I know my friend can be a moron sometimes but easy, he is my friend but I would love to see his face after that last reply Dave man would his face light up, that is what I was trying to tell him last night by just putting it into perspective that you cannot play with 6 cards...oh, oh, wait what about the two three pairs of 2's and 3's and the other guy only has a full house with J's and 3's, sorry bud it just doesn't cut it, a few of my friends are a little slow and I am still learning so once I learn all the rules and learn to bluff a little bit better and bet my chips right and know when to call I may be able to play because I know I have the guts, it seems like the only way I can lose lately is that crafty river it seems like there is always a four on the river that just kills me. The hard thing is with my friends we usually only play five dollar buy ins but the one friend I have who is pretty good is going to have a tourney with 40 dollar buy ins and I just may have to enter to get a little taste of it, thanks again guys.

If I were you, I would volunteer to draft a copy of house rules you are all going to follow. Print out a copy for everybody that is going to be playing and make them READ it, can even have them sign it if you like! Also keep another copy at your game in case any questions should arise. Check out this website, http://www.homepokertourney.com/ , for more information on hosting tourneys etc.. Theres some pretty good rules listed there to give you an idea.
