Poker Gambling Laws???????

Posted Thu Aug 19, 2004 8:15 am GMT by JBuckman
Hey,

Ive got a quick question on the general laws of playing poker. Im looking to setup either some poker nights through advertising at work and playing the games either at home or at a payed venue (ie a room, or small hall) im not sure of the gambling laws or legislations regarding this?? Not sure if its different in the UK to the US?? what laws are being broken and what licenses (If Needed) are required to play games at home privately or in a public place rented for the evening???

if someone could give me some advice that would be great!!

Thanks
JB

For starters, where do you live? If in the U.S, what state?

oh, can't help you there. I'm pretty sure they have more "relaxed" laws regarding gambling than us poor folks in the States. There are quite a few people that post here from the UK and I'm sure they'll chime in soon as they read your post.

I'm in the UK and officially, you cannot hold any games at all for money unless you have a gambling licence. The type of gambling licence a pub holds is not good enough either, they only cover that ridiculous stuff listed on signs above the bar like 'Shove Ha'penny' woteva the hell that is!

That said, I am not aware of the official rules in the privacy of your own home. I am under the impression that so long as no money is on the table, the game is arguably legal. If you made it a tourney with a £xx buy-in and just put the money out of sight somewhere, I think it's cool to continue. The reason I say this is because there are websites that promote home games and list the buy-ins and that sort of thing which would seem a bit stupid if it were illegal. One thing I am pretty sure on is that the 'house' cannot take a rake if you are playing a ring game (with chips representing cash, not actual cash I hasten to add), only casinos can rake the pots.

A lot of that is speculation so don't take any of it as gospel but that is the way I see it. I would not recommend hiring somewhere unless no money for the entry enters the premises and if any1 asks, you playing for fun.........

Looking at the posting then, what do you think the legality of the following is:

I was planning (hoping) to host a Poker night in the works canteen with a £xx entrance fee. This fee would pay for some food, a couple of drinks, prize money (Say £15 out of £20) and a small percentage would go to charity (I could then advertise this as being a "Charity Poker Night").

I was arguing that playing poker would be no different that say a fantasy football league where people are paying to enter and cash prizes are awarded throughout the year? Am I thinking on the right lines here, ie, if someone is allowed to run fantasy football could I not run a poker social event.
