Myself and a few friends were playing hold em' and ran across this situation.
I was holding 10, 4
something like J7K flopped. Turn was a 10. I raised, other player called. River was another 10. We both raised and called, and saw what we had.
He had a 10, 3. I assumed the 4 would be the kicker because everyone has those other community cards. I take the chips, and the game continues. 4 hands later he starts complaining b/s and he wanted to split the pot etc etc.
What was the right thing to do? There was a higher 'kicker' but we both were sharing it, so would it go on to the next highest kicker or would it just be a split pot??

It should be a split pot, you only play with 5 cards, no less no more.
The winning hand(s) is 10,10,10,K,J which you both have.
Since the pot was raked before anyone caught the mistake its tough to deal with, if you know the amount from the pot, split it, it will save a lot of headaches down the road and it's the right thing to do. If you don't, I'd ask him what he threw in the pot, if it sounds reasonable, just give him that amount.
Tell him in future instances it has to be caught at the time, or it's pretty hard to make it right, let him have his one free pass.

I find it funny that there are about 10000000 post which explains this on this site and still it gets asked on a alomost daily basis. Best 5 cards!

I'm moving this to beginner's questions - perhaps it will make more people read the sticky thread I lovingly compiled answering all these questions. I doubt it tho
